The (2010) Equality Act
The Equality Act was introduced in October 2010; the new act pulled nine previous pieces of discriminatory legislation together. At the same time the act placed additional responsibilities on employers who need to ensure staff are trained to avoid any form of direct or indirect discrimination - and for the first time discrimination by association.
It's worth remembering that in 2010 the average award for sex or race discrimination was £19,000 but the average award for disability discrimination was £52,000.
The Equality Act also means that questions about absence, sickness, medication etc cannot be asked at the interview stage unless an employer wants to leave themselves open to a claim of discrimination by an applicant who has had their application for employment rejected.
As a direct result of the new act employers should review their pre-employment forms and documentation - and ensure anybody who is likely to be involved in recruitment is fully trained in relevant aspects of the Equality Act. Employment contracts, employee handbooks, policies and procedures should also be reviewed and updated.
